Speciality Education and Training Doctors and Dentists 

Giles has particular expertise in the law of speciality training for doctors and dentists, an area in which few barristers practise. He advises and represents trainees, and has acted for training bodies, on ARCP outcomes and appeals, removal from or extension of training, the decisions of deaneries and NHS England (formerly Health Education England), CCT and CESR applications and the GMC's specialist register, and the fitness-to-practise and disciplinary processes of universities and medical schools. He also acts for trainees facing MHPS proceedings in the Trusts where they are placed.

He is currently advising and acting in a number of such cases. 

The work is urgent, technical and career-defining: ARCP appeals run to short deadlines, the Gold Guide and the curricula are detailed, and the interaction between training decisions, employment rights and GMC registration is often misunderstood by the bodies making the decisions.

  • Dr K v General Medical Council, 2023. Judicial review of a case examiners' decision. Acting for the doctor.
  • Dr C v General Medical Council, 2022. Judicial review of a decision to investigate a historic matter; resolved with the GMC withdrawing part of its case. Acting for the doctor.
  • R v UK Council for Psychotherapy, 2021. Judicial review of a decision to investigate fitness to practise; permission refused and costs awarded to the UKCP. Acting for the UKCP.

  • Dr MH v Northern Ireland Medical and Dental Training Agency, 2022–2023. Disability and race discrimination claims by a speciality trainee radiologist. Acting for the trainee. Settled.
  • R (Sagar) v Health Education Yorkshire and the Humber [2014] EWHC 3696 (Admin). Judicial review by a GP trainee of the decision to terminate training; claim dismissed. Acting for Health Education England.
